How This Tool Works

The Permit Checker uses a decision matrix built from our research into state building codes, county permit ordinances, and the most common local amendments across all 50 states. It evaluates three key variables that determine permit requirements in the majority of U.S. jurisdictions: the state's typical exemption threshold, whether the structure is attached or detached, and the square footage relative to that threshold.

The tool is most accurate for detached freestanding structures in suburban and rural unincorporated county areas. It may underestimate requirements if you are inside a city's limits (cities are typically stricter than counties) and may overestimate requirements in genuinely rural, unincorporated areas of states like Texas, Louisiana, and Montana.

Use the result as your starting point β€” not your final answer. A 5-minute call to your county building department will give you a definitive answer for your specific property.

Some states have enough variation between counties that a clear yes or no isn't possible without knowing your specific county. Texas, for example, has no statewide code β€” one county may require permits for all structures while an adjacent county has no requirements at all. In these cases, the tool correctly flags the gray zone and points you to the specific variable to confirm: whether you're inside city limits, what your county's adopted threshold is, or how your county treats prefab anchor systems.

No β€” HOA rules are separate from building permit requirements and vary by individual community. This tool covers county building permit requirements only. If you live in an HOA community, also check your CC&Rs and the HOA's ARC approval process. See our HOA carport rules guide for a full walkthrough.

The underlying state data is reviewed and updated annually. Major code changes β€” such as a state adopting a new IRC edition or a large county amending its threshold β€” are reflected in the next update cycle. The tool was last reviewed in early 2025 based on current adopted code editions in each state.

Informational Only. This tool provides general estimates based on typical state permit rules. It does not account for city-specific requirements, special zoning overlays, flood zones, historic districts, or individual county amendments. Always confirm requirements directly with your county building department before starting construction.
